End User License Agreement (EULA)
This End User License Agreement (hereinafter referred to as "Agreement") is a legal agreement between you (hereinafter referred to as "End User" or "you") and Apwned (hereinafter referred to as "Licensor" or "we") for the use of the CCTVCars software (hereinafter referred to as "Software").
By using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not use or install the Software.
License Grant: Subject to the terms and conditions of this Agreement, Licensor grants to you a limited, non-exclusive, non-transferable, and revocable license to use the Software for your personal, non-commercial use only.
Ownership and Copyright: The Software is owned by Licensor and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights therein.
Restrictions: You shall not, and shall not allow any third party to: a) copy, distribute, or modify the Software; b) reverse engineer, decompile, or disassemble the Software; c) create derivative works based on the Software; d) sell, rent, lease, or sublicense the Software; e) remove or alter any proprietary notices or labels on the Software.
Termination: This Agreement shall remain in effect until terminated by either party. Licensor may terminate this Agreement immediately if you breach any of the terms and conditions of this Agreement. Upon termination of this Agreement, you shall immediately cease all use of the Software and destroy all copies of the Software in your possession.
Disclaimer of Warranty: The Software is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Licensor does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free.
Limitation of Liability: Licensor shall not be liable to you or any third party for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Software or this Agreement, even if Licensor has been advised of the possibility of such damages.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Licensor is located, without giving effect to any choice of law or conflict of law provisions. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in the jurisdiction in which Licensor is located.
Entire Agreement: This Agreement constitutes the entire agreement between you and Licensor with respect to the Software and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the Software.
Modifications: Licensor may modify this Agreement at any time by posting a revised version on its website. By continuing to use the Software after such modifications, you agree to be bound by the revised Agreement.
By downloading the Software, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. If you do not agree to the terms and conditions of this Agreement, do not use or install the Software.
