End-User License Agreement (EULA) for Prefab Pack
IMPORTANT: READ CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE PREFABS. BY DOWNLOADING, INSTALLING, OR USING THE PREFABS, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT DOWNLOAD, INSTALL, OR USE THE PREFABS.
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) ("Licensor") for the Prefab Pack product, which includes computer prefabs and may include associated media, printed materials, and "online" or electronic documentation ("Prefabs").
1. LICENSE GRANT. Licensor hereby grants you a personal, non-transferable, non-exclusive license to use the prefabs within the Prefab Pack for the purpose of incorporating them into your own projects or environments.
2. RESTRICTIONS. You may not distribute, sell, sublicense, or otherwise transfer the prefabs or any portion thereof to any third party. You may not modify, adapt, translate, reverse engineer, decompile, or disassemble the prefabs, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
3. OWNERSHIP. The prefabs are licensed, not sold. Licensor retains all right, title, and interest in and to the Prefabs, including all intellectual property rights therein.
4. NO WARRANTY. The prefabs are provided "as is," without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Licensor does not warrant that the operation of the Prefabs will be uninterrupted or error-free, or that the Prefabs will meet your specific requirements.
5. LIMITATION OF LIABILITY. In no event shall Licensor be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of use, arising out of the use or inability to use the Prefabs, even if Licensor has been advised of the possibility of such damages.
6. TERMINATION. This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from Licensor if you fail to comply with any term(s) of this EULA. Upon termination of this license, you shall cease all use of the Prefabs and destroy all copies, full or partial, of the Prefabs.
7. GOVERNING LAW. This EULA shall be governed by and construed in accordance with the laws of District of Columbia, without regard to its conflict of law principles.
8. ENTIRE AGREEMENT. This EULA constitutes the entire agreement between you and Licensor regarding the subject matter hereof and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.
By downloading, installing, or using the Prefabs, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions. If you do not agree to the terms of this EULA, do not download, install, or use the Prefabs.
